1. Scope and application
These Terms and Conditions govern the sale, through the Pit Lane website and its connected booking channels, of the following products and services:
a) Supercar driving experiences and tours on public roads (urban, extra-urban and scenic Motor Valley routes);
b) Professional driving simulator experiences;
c) Event organization (private and corporate events, incentives, motorsport-themed team building);
d) Merchandising with Ferrari and Motor Valley themes (distance selling of physical products).
The purchase of any product or service implies full acceptance of these Terms and Conditions. Contracts concluded with consumers are subject to the provisions of the Italian Consumer Code (Legislative Decree 206/2005).
2. Transparency of the offer: the fleet you see is the fleet you drive
Pit Lane advertises exclusively the cars actually present and available in its own fleet. The images and descriptions on the website correspond to the vehicles really used for the experiences. Any unforeseen unavailability is handled as set out in Article 8.
SECTION A: SUPERCAR DRIVING EXPERIENCES
3. Driver requirements
To take part as a driver, the following must be presented on the day of the experience:
- a valid driving license, recognized as valid in Italy, held for at least 3 years;
- a valid identity document; for non-EU customers, an international driving permit is required.
If the required documents are not presented, the experience cannot be carried out as a driver and no refund is due, without prejudice to the possibility of rescheduling the date in accordance with Article 6 or taking part as a passenger.
4. Conduct of the experiences
On-road driving experiences take place with a qualified Pit Lane tutor sitting next to the driver.
Where the car allows it, passengers may be hosted in the rear seats upon payment of the relevant additional fee. Minors may take part as passengers only with the authorization of a parent or legal guardian and in compliance with the Italian Highway Code rules on the transport of minors.
The length of the experience is expressed in kilometers; the indicated time is an estimate based on a regular driving style in compliance with traffic regulations. Driving at higher speeds may reduce the actual duration for the same number of kilometers.
The driver must:
- comply with the Italian Highway Code: any fines, whether contested on the spot or notified later, are their sole responsibility;
- strictly follow the tutor's instructions.
The tutor is entitled to immediately stop the experience in the event of imprudent or dangerous driving behavior, with no right to any refund. It is understood that Pit Lane has every interest in ensuring the regular conduct of the experience for maximum customer satisfaction.
5. Liability and insurance coverage
All vehicles are covered by third-party liability (RCA) insurance as required by law and by a KASKO (comprehensive) policy. The full details of the coverage can be reviewed when signing the contract during onboarding. The driver is liable for damage caused to the vehicle through willful misconduct or gross negligence, as well as for any consequence arising from violations of the Highway Code or of the tutor's instructions. The applicable excess amounts and any optional additional coverage available for purchase are indicated on each experience page at check-in.
SECTION B: SIMULATOR EXPERIENCES
6-bis. Specific simulator conditions
Simulator sessions have a fixed duration, indicated at the time of purchase, and take place at the Pit Lane premises or at the event location.
Access is also allowed to minors, accompanied by a parent or legal guardian, where compatible with the physical requirements indicated (minimum height, health conditions). Use is not recommended for people suffering from photosensitive epilepsy or serious heart conditions, or for pregnant women; the customer must report any relevant condition in advance.
A customer delay of more than 15 minutes beyond the booked time may result in a proportional reduction of the session or its cancellation without refund, at the staff's discretion and subject to subsequent bookings.
SECTION C: EVENTS
6-ter. Event organization
For private and corporate events (group experiences, simulators on location, tailor-made formats), the financial conditions, program, number of participants and payment terms are defined in a dedicated quotation or contract, which prevails over these Terms for the matters expressly regulated therein.
Unless otherwise agreed in writing:
- confirmation of the event requires payment of a deposit equal to 30% of the total fee;
- the balance is due no later than 7 days before the event date;
- cancellation by the customer up to 30 days before the date entails only the loss of the deposit; beyond that deadline the full fee is due, without prejudice to any rescheduling to a new agreed date.
SECTION D: MERCHANDISING
6-quater. Distance selling of products
Merchandising products are described in their respective product pages; images are illustrative as regards colors and photographic rendering.
Shipping. Shipping times and costs are indicated at checkout. Upon receipt, the customer must check the integrity of the parcel and report any damage to the carrier and to Pit Lane within 48 hours.
Right of withdrawal. Consumers have the right to withdraw from the purchase of physical products within 14 days of receipt, without giving any reason, pursuant to Articles 52 et seq. of the Italian Consumer Code. Withdrawal is exercised by written notice to the contacts indicated in Article 13. Products must be returned intact, unused and in their original packaging; return costs are borne by the customer. The refund, including standard delivery costs, is made within 14 days of receipt of the returned goods, using the same payment method used for the purchase.
The right of withdrawal is excluded for customized products or products made to the customer's specifications (Article 59, letter c, of the Consumer Code).
Legal warranty. Products are covered by the 24-month legal warranty of conformity provided for by the Consumer Code.
COMMON PROVISIONS
6. Bookings, validity, date changes and refunds (experiences)
Experience bookings are associated with a date chosen by the customer.
Validity. The booking is valid for 12 months from the date of purchase. If unable to carry out the experience on the set date, the customer may contact the staff to arrange a new appointment within the validity period.
Date change. Date changes are free of charge and without penalty up to 24 hours before the scheduled date, subject to calendar availability. Beyond that deadline, rescheduling is at Pit Lane's discretion.
Cancellation and refund. Bookings may be cancelled with a full refund within 7 days of the purchase date, provided the request is received at least 72 hours before the experience date. After these deadlines, the booking is non-refundable but remains reschedulable as per the previous paragraph.
Right of withdrawal and services with a specific date. Pursuant to Article 59, letter n, of the Italian Consumer Code, the right of withdrawal provided for distance contracts does not apply to services related to leisure activities where the contract provides for a specific date or period of performance. The refund conditions set out above are granted by Pit Lane on a commercial basis.
No-show. Failure to show up on the booked date, without prior notice, results in the loss of the amount paid.
7. Weather conditions and force majeure
In the event of weather or road conditions deemed dangerous for safety, Pit Lane may reschedule the experience without any penalty for the customer, proposing the first available date. In the event of supervening impossibility due to force majeure, the customer may choose between rescheduling and a full refund.
8. Vehicle availability
The booked car may not be available on the day of the experience due to technical problems or other causes not attributable to Pit Lane. In such cases, the customer is promptly informed and offered, at no additional cost, a car with equal or higher characteristics. If no alternative is accepted by the customer, they may choose between rescheduling and a full refund of the experience.
9. Prices and payments
All prices are expressed in Euro, VAT included.
Payments are accepted by Credit/Debit Card (Stripe circuit), PayPal and Bank Transfer. Payment is due at the time of booking, except for the option, where indicated, of paying a deposit and settling the balance on site on the day of the experience.
Booking confirmation is immediate for payments by card or PayPal. Bookings and Gift Cards paid by bank transfer are confirmed upon receipt of the credit (normally 1-2 working days).
10. Gift Cards
Unlike bookings, Gift Cards do not have a fixed date: the date is chosen by whoever receives the gift, within the validity period.
They exist in two forms:
- Experience Gift Card: at the time of purchase a specific experience from the catalogue is selected and the «This is a gift» option is enabled. The Gift Card entitles the holder to that experience, without a date.
- Amount Gift Card: the Gift Card carries a value in Euro, to be used on one or more experiences chosen by the recipient. This form is available when indicated on the website.
Issue and delivery. Once payment has been made, the purchaser receives by email a Gift Card code and a link to a personal page showing the experience, the message, the code and the expiry date; the page can be printed. If the recipient's email address is provided at the time of purchase, the Gift Card is also sent to them, with the purchaser's message and without any indication of the amount paid; if no such address is provided, delivery to the recipient is the purchaser's responsibility.
Payment. Gift Cards are paid in full at the time of purchase: no deposit applies and nothing is left for the recipient to settle, except for any additional services they request themselves.
- They are valid for 12 months from the date of purchase; the expiry date is shown on the Gift Card itself.
- They are non-refundable, non-nominal and transferable to third parties.
- If not used within the expiry date, validity may be extended by 6 months at a cost of 50% of the card's value.
- During the validity period, they must be converted into a booking by choosing a date on the website or by contacting the Pit Lane staff following the instructions on the Gift Card. Conversion into a booking does not change the original expiry date of the Gift Card.
- After conversion, date changes follow the rules of Article 6.
- Whoever receives the Gift Card may enhance the experience with additional services (for example photo service, video, simulator, extra passenger), purchasing them separately on the website or on site at check-in. The value of the Gift Card remains unchanged and is added to whatever is purchased.
- To take part as a driver, the requirements of Article 3 still apply; they concern the person driving, not the person buying the Gift Card.
11. Images, photos and video recordings
During experiences and events, photos and video recordings may be taken by the staff. Any promotional use of images in which the customer is recognizable takes place only with express consent, collected on site in accordance with the privacy notice. Any content included in the purchased experience (souvenir photos/videos) is delivered in the manner indicated on the product page.
12. Intellectual property and third-party trademarks
Pit Lane Red Passion S.r.l. is an independent operator and is not affiliated with, sponsored or endorsed by Ferrari S.p.A. The trademarks mentioned belong to their respective owners and are used solely for the purpose of describing the vehicles and the territorial context of the Motor Valley.
13. Complaints, applicable law and jurisdiction
For any issue, we invite you to contact us first at the contact details indicated on the website: it is in our interest to resolve any matter in the quickest and most satisfactory way possible.
These Terms are governed by Italian law. For consumer customers residing in Italy, the competent court is that of the consumer's place of residence or domicile. For any other dispute, the Court of Modena shall have jurisdiction.
Consumers retain the right to resort to the alternative dispute resolution (ADR) procedures provided for by the Consumer Code before the competent ADR bodies.
